Welcome to the Calkins Family Association, Inc. (“CFA,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of https://calkinsworld.org and related subdomains, pages, forms, embedded widgets, and member/donor portals we operate (collectively, the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1) Who We Are & Contact
CFA stewards the Hugh Calkins History Center and related programs.

2) Eligibility & Accounts
- You must be at least 13 years old (or the age of digital consent where you live).
- You’re responsible for safeguarding your login and all activity under it.
- We may suspend or terminate access for security risks, non-payment, or violations of these Terms.
3) Memberships, Pledges, Donations & Payments
- Memberships. Tier details and pricing are shown at checkout. Unless stated otherwise, memberships auto-renew on their cycle. Cancel renewal any time before the next billing date via the portal or by contacting us.
- Pledges. A pledge records your intent to give. Unless governed by a signed pledge agreement that states otherwise, pledges are not a debt and can be modified by contacting us.
- Donations. Except in cases of processing error or where required by law, donations are non-refundable. Receipts indicate any tax-deductible portion; consult your tax advisor.
- Processing Fees. Payment processing fees may be added at checkout; your total will include any such fees shown.
- Payment Processing. Payments are handled by Stripe; CFA does not store full card numbers. Use of payment features is also subject to Stripe’s terms and privacy policy.
- Chargebacks. Disputing a charge without first contacting us may result in suspension of benefits until resolved.
4) Events, Programs & Merchandise
Event dates, locations, refund/cancellation windows, and program changes are posted with each event. If we offer physical or digital goods, applicable shipping/delivery and refund terms are displayed at purchase (note: most digital goods are non-returnable once delivered/accessed).
5) Communications (Email/SMS)
By providing your email and/or mobile number, you consent to receive transactional messages (e.g., receipts, confirmations, renewals). For promotional messages, you may opt out at any time. SMS: message/data rates may apply; reply STOP to opt out, HELP for help. Essential transactional notices may still be sent.
6) Acceptable Use & Community Conduct
You agree not to:
- Violate laws or third-party rights (IP, privacy, publicity);
- Post content that is unlawful, harassing, defamatory, obscene, hateful, or otherwise objectionable;
- Impersonate others or misrepresent affiliation;
- Attempt to access another user’s account or interfere with Site security; deploy malware, scraping, or automated harvesting without our written consent.
We may remove content or restrict access that violates these rules.
7) User Content & Licenses
If you submit or upload content (e.g., posts, comments, testimonials, photos), you grant CFA a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with the Site, our programs, and mission. You represent that you have the rights to grant this license and that your content complies with these Terms.
8) Intellectual Property
The Site and its contents (text, graphics, logos, images, video, software) are owned by CFA or our licensors and protected by law. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from our content. CFA names and logos may not be used without prior written permission.
9) Third-Party Services & Embedded Content
We use trusted vendors to operate the Site and programs, including Stripe (payments), GoHighLevel / GiveSuite (CRM, forms, email/SMS, automations), hosting/CDN/email (e.g., Bluehost, Cloudflare, Microsoft 365/Exchange), IT/security/analytics, and Google Analytics (GA4). The Site may embed third-party content (e.g., videos, maps). Your use of third-party services is governed by their terms and policies; we are not responsible for their content or practices.
10) Privacy & Cookies
Your use of the Site is subject to our Privacy Policy, which explains what we collect, how we use/share it, your choices (including cookie consent), and your rights (CCPA/CPRA, GDPR, etc.). You can adjust cookie preferences via the Cookie Settings link in our footer and in your browser.
11) Accessibility
We aim to provide an accessible experience. If you encounter barriers, contact accessibility@calkinsworld.org (or privacy@calkinsworld.org) and we’ll work to address them.
12) Disclaimers (No Professional Advice)
The Site is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Information on the Site is for general purposes only and is not legal, tax, or professional advice.
13) Limitation of Liability
To the maximum extent permitted by law, CFA and its officers, directors, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site is limited to the greater of (a) the amount you paid to CFA through the Site in the 12 months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations; those limits may not apply to you.
14) Indemnification
You agree to defend, indemnify, and hold harmless CFA and its officers, directors, volunteers, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your content, your use of the Site, or your violation of these Terms.
15) Copyright/DMCA
If you believe material on the Site infringes your copyright, send a notice including all information required by 17 U.S.C. §512(c)(3) to:

16) Changes to the Site or These Terms
We may update the Site and these Terms from time to time. If changes are material, we’ll provide notice (e.g., on this page or via portal/email). Changes take effect upon posting unless stated otherwise. Your continued use after updates means you accept the revised Terms.
17) Governing Law & Venue
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. You consent to exclusive jurisdiction and venue in the state and federal courts located in Connecticut for any dispute not subject to small-claims court.
18) International Use
We operate from the United States and make no representation that the Site is appropriate or available elsewhere. You’re responsible for compliance with local laws.
19) Termination
You may stop using the Site at any time. We may suspend or terminate access for any reason, including security risks, non-payment, or violations of these Terms. Provisions that by their nature should survive (e.g., IP, disclaimers, limits of liability, indemnity, and governing law) will survive termination.
